Rivers and Harbors Act of 1899

This Act prohibits the creation of any obstruction to the navigable capacity of any of the waters of the United States without specific approval of the Chief Engineer of the US Army Corps of Engineers. Permits issued under Section 10 of this Act are not associated with protection of wetlands per se and the topic will not be further reviewed here. Please note that Section 10 permits are required along with permits issued under Section 404 of the Clean Water Act when the affected wetlands are defined as navigable.
