Virginia, the nation’s leading data center market, continues to refine its regulatory framework as policymakers seek to balance digital infrastructure and energy growth with community interests, environmental considerations, and energy demands. Actions including JLARC’s Virginia Data Center Study and Executive Order 22 highlight Virginia’s focus on understanding and managing the opportunities and challenges associated with digital infrastructure expansion.

Policymakers across the country have taken steps at the local and state levels to regulate and guide digital infrastructure development as opposition increases. For example, in July, New York was the first state to implement a statewide pause on digital infrastructure with an Executive Order that halts data center projects exceeding 50 MW until new state standards are established. In comparison, in August, Pennsylvania’s Executive Order 2026-05 established a more structured approach to evaluating and permitting data center projects. Local governments nationwide have also updated zoning ordinances, land use policies, and review processes in response to the rapid growth in digital infrastructure projects.

We are watching as Virginia and other states continue to refine regulatory frameworks for data center development, while communities, policymakers, and industry stakeholders increasingly expect greater transparency, earlier engagement, responsible environmental stewardship, and thoughtful infrastructure planning. Across the country, the data center industry is entering a new phase, one characterized by heightened expectations for thoughtful planning, stakeholder collaboration, and environmental stewardship.
