On October 17, 2022, the U.S. Army Corps of Engineers – Norfolk District released the draft of a new 2022 State Programmatic General Permit (SPGP) for public comment that addresses impacts to tidal or non-tidal Waters of the U.S. (WOTUS) from certain piers, aquaculture, shoreline stabilization, dredging, and other (PASDO) activities (22-SPGP-PASDO). SPGPs that address Linear Transportation (22-SPGP-LT) and Residential and Commercial Development (22-SPGP-RCIR) were effective as of August 8, 2022 (see our Field Notes article). The Corps is issuing the 22-SPGP-PASDO to reduce duplicative federal, state, and local review for these types of projects.
