On June 22, 2023, Virginia’s State Water Control Board (Board) adopted new Virginia Erosion and Stormwater Management Regulations (9VAC25-875) to consolidate and clarify program requirements, eliminate redundancies, and correct inconsistencies between the erosion and sediment control and stormwater management program regulations. The regulatory requirements of the adopted Virginia Erosion and Stormwater Management Regulation (9VAC25-875) will become effective July 1, 2024. 

The intent of this new regulation is to combine and clarify the existing regulatory requirements from the Erosion and Sediment Control (9VAC25-840), Erosion and Sediment Control and Stormwater Management Certification (9VAC25-850) and Stormwater Management (9VAC25-870) regulations. The consolidation followed 2016 action from the Virginia General Assembly to improve efficiency in the regulations (HB 1250 and SB 673). The Virginia Department of Environmental (DEQ) stated in the February 2019 Notice of Intended Regulatory Action: No substantive changes to existing erosion and sediment control minimum standards or to the post-construction stormwater management technical criteria are part of this regulatory action.  

The Board also approved the following regulatory changes:

  1. Virginia Pollutant Discharge Elimination System (VPDES) Permit Regulation (9VAC25-31).
  2. Virginia Water Protection (VWP) Permit Program Regulation (9VAC25-210).
  3. Erosion and Sediment Control Regulations (9VAC25-840), Virginia Stormwater Management Program Regulation (9VAC25-870), and General VPDES Permit for Discharges of Stormwater from Construction Activities (9VAC25-880).
  4. Certification of Nonpoint Source Nutrient Credits (9VAC25-900).
